Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ReciMind application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

These Terms apply to all users of the App, including free-tier users and subscribers.

2. Description of Service

ReciMind is an AI-powered recipe assistant that:

• Uses your device camera or photo library to identify food ingredients
• Generates personalized recipes based on those ingredients and your preferences
• Scans recipe cards or photographs of dishes to digitize or reverse-engineer recipes
• Stores your recipe history and lets you save favorites

The App uses Google's Gemini AI models to process images and generate recipe content. AI-generated output may vary and is provided as a creative suggestion, not professional advice.

3. Accounts

3.1 Registration

You must be at least 13 years old (or 16 in the European Economic Area) to use this App. By creating an account, you represent that you meet this age requirement. You must create an account to use the App's AI and recipe storage features. You can sign up with an email and password or via Google OAuth.

3.2 Your Responsibilities

• Provide accurate information when creating your account.
• Keep your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access.

3.3 Account Deletion

You may delete your account at any time from Settings → Delete Account. Deletion is permanent and removes all your data from our servers.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Upload photos containing Personally Identifiable Information (PII) of others, illegal content, or highly sensitive material.
• Attempt to reverse-engineer, decompile, or extract the App's source code.
• Circumvent or attempt to bypass rate limits, authentication, or security controls.
• Use the App to generate content that is harmful, offensive, or violates the rights of others.
• Automate requests to the App's backend services (scraping, bots, scripts) without our written permission.
• Resell, sublicense, or commercially exploit access to the App's backend outside of your personal use.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions and Billing

5.1 Free Tier

ReciMind is available free of charge. Free-tier users receive one trial use of each AI scanning feature (fridge scan, recipe card scan, and dish identification). A daily limit of 50 AI requests also applies.

5.2 ReciMind Pro

ReciMind Pro unlocks the following features:

• Unlimited fridge scanning — scan your fridge or pantry as many times as you like to detect ingredients
• Unlimited recipe card scanning — photograph any cookbook page, recipe card, or handwritten note to digitize it
• Unlimited dish identification — photograph any prepared dish to have a recipe reverse-engineered from it
• Recipe assistant — chat with an AI assistant to refine, adapt, or ask questions about any saved recipe

Free-tier users receive one trial use of each scanning feature before being prompted to upgrade. Subscriptions are billed on a monthly or annual basis as displayed at the time of purchase.

5.3 In-App Purchases

All purchases are processed through Apple App Store (iOS) or Google Play Store (Android) using RevenueCat. By purchasing a subscription, you agree to the payment terms of the respective platform.

5.4 Cancellation

You may cancel your subscription at any time through your platform's subscription management settings (Apple ID settings or Google Play subscriptions). Cancellation takes effect at the end of the current billing period. Access to Pro features continues until the period ends.

5.5 Refunds

Refund eligibility is governed by Apple's or Google's refund policies. We do not process refunds directly — please contact the relevant platform for refund requests.

5.6 Price Changes

We may change subscription prices at any time. Any price change will take effect at the start of the next billing period, and we will notify you in advance.

6. AI-Generated Content Disclaimer

Recipes and other content generated by ReciMind are produced by artificial intelligence and are provided as suggestions only. They are not:

• Professional nutritional or dietary advice
• Medical advice (e.g., for allergies or health conditions)
• Guaranteed to be accurate, complete, or suitable for your specific situation

Always use your own judgment when preparing food. If you have dietary restrictions, allergies, or health conditions, consult a qualified professional before following AI-generated recipe guidance.

We are not liable for any adverse outcomes resulting from following AI-generated recipes.

7. Intellectual Property

7.1 The App

ReciMind, its name, logo, design, and underlying technology are owned by us and protected by applicable intellectual property laws. You may not copy, modify, or redistribute any part of the App without our written permission.

7.2 Your Content

You own the recipes generated using your inputs. We do not claim ownership of AI-generated recipes saved to your account. You grant us a limited license to store and display your recipe data for the purpose of operating the service.

You are solely responsible for ensuring you have the legal right to scan, upload, or process any images or texts using the App. We are not liable for any copyright infringement resulting from your use of the App to digitize or recreate copyrighted recipes or cookbooks.

7.3 Feedback

If you submit feedback, bug reports, or suggestions, you grant us the right to use that feedback to improve the App without any obligation to compensate you.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it — it explains what data we collect, how photos are handled, and your rights.

9. Third-Party Services

The App integrates with third-party services including Google Gemini AI, Supabase, and RevenueCat. Your use of those integrations is subject to their respective terms and policies. We are not responsible for the actions, policies, or availability of third-party services.

10. Availability and Changes

We may:

• Modify, suspend, or discontinue any feature or the entire App at any time.
• Change these Terms at any time by updating this document and notifying you in the App.

Continued use after changes are published constitutes acceptance of the updated Terms. We aim to maintain the App but do not guarantee uninterrupted availability. We are not liable for any downtime or service interruptions.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided “as is” without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
• Our total liability to you for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim (or €50 if you are a free-tier user).

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless ReciMind, its owners, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the App if:

• You violate these Terms.
• We reasonably believe your account is being used fraudulently or abusively.
• We are required to do so by law.

Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimer, limitation of liability, and governing law) will survive.

14. App Store and Google Play Requirements

These Terms are between you and ReciMind, not with Apple Inc. or Google LLC. We, not Apple or Google, are solely responsible for the App and its content. Apple and Google have no obligation to furnish any maintenance or support services with respect to the App. Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, they will have the right to enforce these Terms against you.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Norway, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the App will be resolved through the courts of Norway. If you are a consumer resident in the European Economic Area (EEA), you will benefit from any mandatory provisions of the law of the country in which you are resident and may bring proceedings in your local courts.

For users outside the EEA: If you are located outside the EEA (including the United States), you agree that any claims against us shall be resolved on an individual basis and not as part of a class action.
